Mantua man faces prison time in crash; was fined in a previous Aurora incident

A Mantua Township man faces a mandatory one to five years in prison after recently pleading guilty to causing a crash that left another driver with serious injuries in Streetsboro in March 2013.

Portage County Prosecutor Victor Vigluicci said Dwayne E. Montgomery, 50, of Route 82, pleaded guilty to aggravated vehicular assault, a third-degree felony, in Portage County Common Pleas Judge Laurie Pittman's courtroom.

Vigluicci said Streetsboro police investigated a crash at Route 43 and Frost Road on March 22, 2013, when Montgomery's westbound vehicle collided at a high rate of speed with another vehicle stopped at a red light on Frost Road.

Montgomery's vehicle pushed the victim's vehicle through the intersection, totaling it and trapping the victim, Craig M. Bender, according to Vigluicci. Montgomery's vehicle traveled another one-eighth of a mile, left the road and struck a utility pole.

Bender was seriously injured in the crash. Montgomery was indicted by a Portage County grand jury on Sept. 19, 2013, according to Vigluicci.

Charges of driving under suspension, speeding and operating without reasonable control, all misdemeanors, were dismissed at the time of Montgomery's plea, according to court records.

Montgomery previously had been charged with failing to stop after an accident, a fourth-degree misdemeanor, and reckless operation, a minor misdemeanor, after striking a Richmond Heights woman's vehicle while driving southbound on Route 43 in Aurora on May 8, 2012, according to court records.

He pleaded no contest to both charges and was fined $150 by Acting Judge Stephen Smith in Portage County Municipal Court in Kent on May 30, 2012, court records indicate.

The victim in that case filed a lawsuit against Montgomery in Portage County Common Pleas Court in January 2013. It was settled with Montgomery's insurance company and dismissed in March 2013, court records indicate.
